In these Terms & Conditions "we" "us" and "our" are to but not limited by the Happi Chix management, employees and agents.  References to "our website" or "the website" are to www.happichix.co.uk www.happichix.com www.fashionableplussizewomen.com and www.fashionableplussizewomen.co.uk.


You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

 

You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

 

PRODUCT INFORMATION

 

The product and pricing information on our website is deemed to be accurate at the time of data entry. We cannot in any way be held responsible for inaccuracies of whatever nature. We also retain the right to change pricing or product information at any time. Our stock levels are monitored daily. We cannot be held responsible for any delay in delivery because of invalid stock level information. The customer shall not be charged for any items that were not delivered due to stock depletion.

 

All sizes and measurements are in accordance with our published size guide see our home page. Although the size guide is universally accepted, the sizes of any garment are an approximation. We endeavour to retain accuracy to the best of our ability. We cannot be held responsible for discrepancies in sizes of our products due to design and manufacturing methods.

 

We are bound by screen colours and photo material to display the colours of our products. We cannot be held responsible for colour discrepancies due to monitor settings or computer adjustments.

 

PRICING

 

Our prices include Value Added Tax VAT at 15% but do not include postage/delivery and packaging costs.

 

Our standard UK postage and packaging rate per order is Free

Our standard European postage rate per order is £10.00.

Our rest of the world rate per order is £15.00

 

Special Next Day Delivery is offered at an additional cost.

 

The total cost of the order is the price of the products as described on our website (including VAT) plus the cost of postage and packaging. Prices are in GBP please check prior to purchase the cost in your own local currency.

 

PRODUCT ORDERS

 

All product orders will be confirmed by e-mail. Please check your email mailbox regularly and make sure our e-mails have been delivered to your regular inbox and not to your junk mail inbox.

 

After your order has been received, your Paypal, credit/debit card payment will be collected via the Paypal server at which point we acknowledge the contract and will execute the order by sending you the chosen product. We maintain the right to refuse to execute an order at any time. We also accept cheques and crossed postal orders, please email us for details.  Google customers will receive notification via their Google account.

 

You have the right to cancel your order at any time within the rules described by the Distance Selling Regulations.

 

The goods sent out by us are new with labels professionally attached, unworn, unwashed and/or untreated. Returned goods, as long as they are in the same condition as described above will be fully refunded. Worn, soiled and/or damaged items of clothing will not be accepted.

 

ORDER REFUSALS

 

Orders can and will be refused for reasons including but not limited by:

 

The product being withdrawn or not being stocked.

 

The product not being stocked in your size/colour.

 

Discovery of a discrepancy/error in either pricing and/or description.

 

Non-Authorisation after validation of your Credit Card and related personal details by our Credit/Debit Card service provider PayPal.

 

RETURNS POLICY

 

We accept returns if you are not satisfied with the item you purchased from Happi Chix.

 

Should you wish to return an item, please e-mail service@happichix.co.uk and explain the reason for the return as well as the order number, your name and your postal address. You will then receive a returns authorization. The cost of returning the item is to be borne by the sender.

 

When returning the goods to us, we recommend that you take out postal insurance if the value of the item exceeds £32 and a certificate of posting (available free of charge from any Post Office) if under this amount.

 

Accepted returns and refunds are subject to but not limited by the following criteria:

 

The item must be accompanied by the original documents that were enclosed.

 

The item has to be returned within 14 days of purchase.

 

The item must be unworn and unsoiled.

 

The item must be packaged in the same way as received.

 

None of the tags should be removed, changed or damaged.

 

Some items such as swimwear earrings and lingerie can not be returned for hygiene reasons.

 

If all the above criteria are satisfied, you will receive an unequivocal refund within 2 days.

 

REFUNDS

 

Refunds do not include postage and packaging, unless the item was sent in error, is damaged or faulty or not in accordance with the original specification.

 

RETURNING GOODS FOR AN EXCHANGE

 

When returning goods for an exchange, you are responsible for the cost of postage and packaging for the new item that you wish to receive.

 

DISTANCE SELLING REGULATIONS

 

Our company and products are subject to the UK Distance Selling Regulations (see our Terms & Conditions and Privacy Policy).

In case you wish to cancel your order, you must do so by law within 7 working days:

You must return the cancelled items to us at your own cost. If we do not receive the cancelled items back then we may arrange collection at your cost. In case the item is lost when returned to us, you will be held responsible. We therefore recommend that you will take out postal insurance when returning the item to us.

 

The Distance Selling Regulations do not apply to goods that cannot be returned for hygiene reasons.

Happi Chix returns policy does not in any way affect your statutory rights.

 

MODIFICATION

 

Happi Chix reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this site

 

Happi Chix have complete discretion to modify or remove any part of this site without warning or liability arising from such action.
